Texting and Driving is becoming a primary offense in Florida and will be punishable by fines depending on the number of offenses. This matter has become a law in most of the US states excluding Florida. However, recently, the Florida house passed a bill (104-9) that will ban texting and driving. Currently, this is a secondary offense which means that law enforcement officers couldn’t stop you just for texting and driving. They could only cite you for this if they pulled you over for a primary offense. Now, texting and driving will become a primary offense which means that any law enforcement officer can cite you if they see you texting while driving. Ticketing on this will begin on January 1, 2020. The first offense will be penalized at $30 and second offense at $60 (court costs and fees will also apply).

This law does not apply to drivers who are using their GPS system for “navigation purposes”, drivers reporting an emergency or criminal or suspicious activity to law enforcement authorities, drivers who are conducting wireless interpersonal communication that does not require manual entry of multiple letters, numbers, etc. except to activate, deactivate or initiate a feature or function, or drivers who are in “a motor vehicle that is stationary”.

As a result to some of the lawmaker’s concerns, this bill also requires statistical reports to guard racial profiling.
